General Terms and Conditions of E-Commerce

These terms of sale are entered into on the one hand by SARL Mongravey with a capital of 2,310,000 euros, whose registered office is located in Arsac, registered with the Bordeaux Trade and Companies Register under number 438 435 075 000 17, hereinafter referred to as “Mongravey,” and managing the website vignobles-bernaleau.com, and on the other hand, by any natural or legal person wishing to make a purchase via the website vignoles-bernaleau.com, hereinafter referred to as “the buyer.”

Article 1.
Purpose These terms of sale aim to define the contractual relations between SARL Mongravey and the buyer and the conditions applicable to any purchase made through the website https://vignobles-bernaleau.com. The purchase of a product through this site implies acceptance without reservation by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://vignobles-bernaleau.com is unrelated to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity, enabling them to commit under these general terms of sale. SARL Mongravey retains the possibility of modifying these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Consequently, the conditions applicable will be those in effect on the date of the order by the buyer.

Article 2.
Products The products offered are those listed on the website https://vignobles-bernaleau.com of SARL Mongravey, within the limits of available stocks. SARL Mongravey reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description listing its main technical characteristics. The photographs are as faithful as possible but do not engage the Seller in any way. Article 3.
Prices The prices appearing on the product data sheets on the internet catalog are in Euros (€) all taxes included (VAT) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. SARL Mongravey reserves the right to change its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, for any order over or equal to 350 euros including tax, shipping costs are free; for any order below 350 euros including tax, a flat rate for shipping costs will be invoiced to the buyer.

Article 4.
Ordering and Payment Terms Before placing an order, the buyer must create an account on the website https://vignobles-bernaleau.com. The account creation section is accessible directly from the side menu bar. Each time the buyer visits and wishes to place an order or check their account (order status, profile, etc.), they must log in using this information. SARL Mongravey offers the buyer the option to order and pay for products in several steps, with 3 payment options to choose from:

  • Payment by check: the buyer selects the products they wish to order in the “cart,” modifies if necessary (quantities, references, etc.), verifies the delivery address or provides a new one. Then, the shipping costs are calculated and presented to the buyer, as well as the name of the carrier. Next, the buyer chooses their preferred payment method: “Payment by check.” Finally, the last step allows the buyer to review all the information, acknowledge and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the “Confirm my order” button. This final click forms the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation confirming the registration of their order. To finalize the payment and trigger the processing of their order, the buyer must print this order confirmation, along with their check made out to SARL Mongravey at the following address: SARL Mongravey, 8 Avenue Jean-Luc Vonderheyden 33460 ARSAC. No cash payments should be sent. Only checks issued by a French bank will be accepted. Upon receipt of the check, the order will be processed, and the buyer will be notified by email. SARL Mongravey will ship the products no sooner than 2 working days after receipt of the check corresponding to the order, subject to availability.
  • Payment by bank transfer: the buyer selects the products they wish to order in the “cart,” modifies if necessary (quantities, references, etc.), verifies the delivery address or provides a new one. Then, the shipping costs are calculated and presented to the buyer, as well as the name of the carrier. Next, the buyer chooses their preferred payment method: “Payment by bank transfer.” Finally, the last step allows the buyer to review all the information, acknowledge and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the “Confirm my order” button. This final click forms the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation confirming the registration of their order. To finalize the payment and trigger the processing of their order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to the bank account of SARL Mongravey, the details of which are communicated to the buyer. Upon receipt of the transfer, the order will be processed, and the buyer will be notified by email. SARL Mongravey will ship the products no sooner than 14 working days after receipt of the transfer corresponding to the order, subject to availability.
  • Secure payment by credit card: the buyer selects the products they wish to order in the “cart,” modifies if necessary (quantities, references, etc.), verifies the delivery address or provides a new one. Then, the shipping costs are calculated and presented to the buyer, as well as the name of the carrier. The next step allows the buyer to review all the information, acknowledge and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the “Confirm my order” button. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable. In the context of payments by credit card, https://vignobles-bernaleau.com has no access to any customer payment information. Confirmation of an order implies acceptance of these terms of sale, recognition of having perfect knowledge of them, and waiver of the buyer’s own terms and conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. Article 5.
Retention of Title SARL Mongravey retains full and complete ownership of the products sold until full payment, including principal, fees, and taxes.

Article 6.
Withdrawal In accordance with Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.

Article 7.
Delivery Deliveries are made to the address indicated on the order form, which can only be within the agreed geographic area. Orders are processed by UPS La Ruche, a tracked delivery service, without signature required. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer will be reimbursed. SARL Mongravey may provide the buyer with the tracking number of their package by email. The buyer will be delivered to their home by their carrier. In the event of the buyer’s absence, they will receive a delivery notice from their carrier, which will allow them to collect the ordered products from the nearest post office, for a period indicated by the postal services. The risks associated with transport are the responsibility of the buyer from the moment the items leave the premises of SARL Mongravey. The buyer is required to check the condition of the packaging of the goods and their contents upon delivery, in the presence of the representative of La Poste or the carrier. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8.
Warranty All products supplied by SARL Mongravey benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it can be returned to SARL Mongravey, which will take it back, exchange it, or refund it. All claims, requests for exchange, or refunds must be made by post to the following address: SARL Mongravey, within thirty days after delivery.

Article 9.
Liability SARL Mongravey, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other unintentional problems.

Article 10.
Intellectual Property All elements of the site https://vignobles-bernaleau.com are and remain the intellectual and exclusive property of SARL Mongravey. No one is authorized to reproduce, exploit, or use in any capacity, even partially, elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11.
Personal Data
SARL Mongravey undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978. Article 12.
Dispute Resolution
These distance selling terms are subject to French law. For any disputes or disputes, the competent court will be that of Bordeaux.
